So, you took this to court and the magistrate found against you?

What was the legal basis of the judgement ?

Wouldn't be a magistrate. They handle criminal cases. It would be a district judge.

Yes i did take it to court and yes i did loose he had recieved a chargeback via his credit card company, yet had not returned the coral.

From memory it was not as described

I know….Why get in to this one…?

But I am struggling with this post, and I have read it a couple of times.

So I'll try to break it down:

The OP has bought a watch from a watch dealer, and payed the watch with a trade/money combo.
The watch was available in the shop, and was handled and viewed by the buyer.
There is nothing stated that the watch was brand new (or NOS), so we have to assume that it is a used watch.

Once at home, the OP finds out that one of the endlinks is not correct.

And based on this, the deal should be reversed.

After an amount of posts, more info come out - that the watch was losing time (18 s/d).

@ninman - have I got this right?

Sorry - but we Swedes could be a bit dull, but also a little curious...?

The simple rule is fairness and honesty, as much as to disclose to the innocent buyers, more so to newbie watch collectors, all and any defects and replacement parts to get trust of the clients/customers. If the shop owner is open to return or replacement, he/she will get more purchases from the same buyer or collector in the future or succeeding plan to buy another. it is not simply about existing laws because in a rare hobby like this, trust and good faith is above all else. as long as your client or customer enjoys your watch, everybody wins.

I will only comment once as I am not interested in theoretical debates on watch returns (and also as I don’t see the point of the post - clearly not seeking second opinion, making a statement that it’s your right?)

What I would suggest to the OP is to think through purchases better - as returns are a pain for both a buyer and a seller.

On a previous thread the OP bought the FOIS and two days later, opened another thread to return it… which interestingly didn’t work, even with a brand new item (so how would it on a vintage one, which was traded for another watch… one would ask?).

Buyer's remorse. I've had it many times over the years with watches. I simply take it as a learning experience and move on.
