So an update. I asked EBay to step in after not receiving the item by the estimated arrival date. They forced me to send a message to the seller, then gave him a certain period of time to respond before they made a decision. This morning (the last day for him to respond before I could escalate at EBay) he sends a message with a new tracking number that says a package left Georgia on 1/30 and asks me to close the dispute.

I of course do not close the dispute and tell EBay I think this is a scam and would like a refund. Due to the updated tracking, however, they put my dispute on a 10 day hold to allow for this “package” to arrive. After the 10 days, they will again review the situation.

Well. He’s a professional. He understands the timing perfectly and has now sent, I’m guessing, an empty box.

That is my assumption as well. I assume the way to protect myself here is to either not open the box or take video of myself opening the box?

I remember seeing a video of a buyer in this situation opening a box in a police station. Not sure how that would help.

Not sure how opening a box on film could be considered proof of anything anyway, unless you film one continuous shot as the package is actually delivered and signed for, and the subsequently opened.

I might actually do this. And if no one else was home to help me, I might hand my iPhone to the delivery guy with the promise that it will take less than 30 seconds.

Edit to add: the guy had previously relisted the watch after you bought it, correct? Did he sell it again, and is eBay aware of these details? If yes, what can they possibly say to you?

I took photos of the listing (it was a different username) and reported it to EBay as a fraudulent listing. Then sent a message to the seller saying he needed to find a new watch to scam folks with.

Within a few hours of receiving the final documentation, EBay confirmed the case had been closed in my favor and I will receive a refund in 2-4 days.

I recently got sent a fake watch as well. It got caught in the custom's and destroyed by the authorities. No documentation needed at all, eBay refunded me immediately. Very nice experience.

Just wondering what the most expensive piece they accidentally incinerated was. I mean, they must have a lot of faith in their experts.

Also, this cannot be the process! I mean, they did give you a chance to view it or to make your case first...right?

Nope. But there were so many red flags that I wasn't surprised at all to see it caught in the net. I am glad it did - they did all the work for me! Funnily enough, in this case the watch have been caught in the toll, evaluated by the custom's and then authenticated by the trademark holders... Then a (very) formal document written by a law firm got sent to me for signing in two separate envelopes (one by priority mail, one by signed delivery) and during the whole process I've been kept notified by email...

All of this hasn't cost me anything. In contrast, if a parcel containing a $15 watch gets opened by the custom's and sent on to me, I'll be billed $0 in taxes but $20 in handling fee 🤦🤦
