Hence why I offered 50% of the costs of it all. That way if it shows up or I get paid out from RM (which I don't think I will) we can settle which way the other 50% goes.

So. If I buy a 1000 dollar dial here from a member. And it he made a simple mistake and I said I want a refund. He sends me the money because he know I’m good for the return. I ship the part. Send him tracking. Gets lost. 5 months passes. I’m
Suppose to tell him. Oh let’s split the cost because it’s not my fault. Or hey you may get it back. No I am not. I am going to send him the funds back. I’ll deal with the shipping company. Get my insurance. Everyone is happy. If he gets in couple months down the line. Then he sends me back the funds. But it is not on him or his fault for anything.

Greg - At some point in the coming week I will send you the cash back if it turns up, you can sell it for what it is, an 1171 clasp (bent on corners) and Mark 2 links with a few bent links.

Isn't the unwritten rule that the shipper is responsible for the item to arrive at destination? It's not always "fair" but it is what it is...

I've had items stuck 4-5 weeks at customs but 5 months is way out there.

Did you make a claim with Royal Mail? I don't quite understand sure they wouldn't honor it because USPS lost it.

Don’t try and bash me. I kept it confidential at the beginning of this thread. Your the one that wanted to chime in. I was wondering if I was at fault or not. It was a simple mistake on my end.i stepped up to it and owned it. Refunded you your money no questions asked.

Im not giving you a bashing, why would I do that, you brought it here, I simply responded as I wasn't going to be branded a scammer/thief etc. Like I said, right now, my family is dealing with a serious issue and I don't need the added stress right now.

What I can say is that I respect your patience, but I am at the mercy of Royal Mail

Funds will be sent at some point next week. Now I need to concentrate at the personal issue at hand.

I had a package from Hong Kong get lost in NY customs for about 6 months. Seller sent me another watch and all was forgotten until out of the blue one day the original watch showed up at my door.

I say be cool...

Generally, the onus is always on the shipper until delivery and (I believe) it's usually only the shipper who can pursue the insurance claim. One thing that a lot of watch guys don't seem to realize is that the fine print of the terms of USPS insurance explicitly exclude jewelry from coverage eligibility, and (I believe) watches constitute "jewelry" according to the USPS. That means a lot of you are probably risking a total loss every time you ship a watch thinking that it's "insured" by USPS.

The tracking system isn't perfect, either; because it's human beings wielding at least some of those scanners involved. I once had a vintage hockey helmet shipped from Canada by the eBay seller in July of 2016 scan "delivered" a week later and never show up at my door. My local Post Office blamed it on my neighbors, saying it had to have just been stolen from in front of my door. About 7 months later, it just showed up with that day's mail. When I called the Post Office, the Manager said he'd found it going through some old packages in one of their rooms. So, try to get hold of the local P.O. Manager and explain that you'd appreciate it if someone could maybe look around because it could have just gotten lost somewhere instead of being scanned when it arrived there. They can be reflexively defensive, so your best bet is to start off acknowledging that you know it's a long shot, because the last recorded scan was in Customs.

As between buyer and seller in this particular case, I'd side with the buyer, only because if the item was incorrectly-described, even completely innocently, then that's what necessitated the return in the first place, rather than, say, where the buyer simply changed his mind. For that reason, I'd expect the seller to absorb the loss and have to deal with the hassle of recouping it from the USPS and/or Royal Mail. Nevertheless, the seller comes across as being about as honest and legitimate as possible, for having returned the money on request as he did, instead of waiting until he actually received the returned package.

I agree a lot of the discussion could have been done in private but I'm not sure why the distinction of professional or hobbyist matters. 😕

Depending on the country it matters a lot. In Germany, it is like this:
Business to consumer: Seller is responsible for shipping.
Consumer to consumer: Seller is only responsible for having the item shipped but not that it arrives.
No idea of B2B as I am not doing business.

No they are not an insurance. They are a forced refund mechanism.

I think the 50-50 deal was a fair one until and unless the watch turns up or insurance payments are made.
The reasons are as follows:
1/ presumably 2 people are acting in good faith who care about their good reputation;
2/ while it is true the risk of shipment is implied on the shipper in this instance nothing would have happened if it weren’t for the initial mistake. So yes it’s fair for the seller to carry a part of the risk for now.
3/ even with proper insurance it’s clear the insurance collection can fail with national postal services.

Edit / add/ however i just noticed the item was declared at £15 as gift, I wonder how the insurance can work in that case. This could change the overall equation.
