It’s here! Super fast allocation from Amazon. I think I see why they got in trouble!

You know some Rolex fanatic is going to see this photo and use it as "proof" that O&P are terrible infringers...

I’d thought of that. I was also starting to get worried they’ll come after me because my name is Alex.

Just keep it up, Rolex. The American auto industry, IBM, Lehman Brothers and too many other corporate icons to mention - all of them having thought that they too were invincible - have come and gone or are shadows now of what they once were.

If I change my OF screen name to hanswilsdorf, how long do you think that it will take before I get sued? ::stirthepot::

Well... it's after business hours in Switzerland so you've probably got at least 12 hours...

I actually think Rolex has them on points 1 and 3 but missed the trifecta. Not shedding any tears for Rolex.

The courts don't agree. For me, this is proof that just because you make a claim of infringement, doesn't mean it's a valid claim...

I actually contacted the company directly, and offered to send them money, no strings attached, in their battle again the Royal Crown. They never responded. Oh well…

I read the article as all 3 have to be true to reject under that article. Two doesn’t cut it. The article mentions a main sticking point was #2 and Rolex appealed it and also dug in on the “reputation” claim. I think the courts got it right there. Anyway, obviously doesn’t matter what I think. I just think the logos are indeed very similar.

This bit gets me:
“Lawyers for Rolex, argued that the "average, reasonably well informed consumer" would likely call the Rolex line of watches to mind when looking at the Oyster & Pop logo.”
I would think the average, reasonably well informed consumer would know the difference…. They are after all informed!
I would think this is an own goal from the lawyer vermin.

Next time I have bronchitis and cough up a shitload of lung oysters, l must send them posthaste to their rightful owner…..Rolex!
🤮
Hmmmmmn! Just thinking about it maybe I have a case against Rolex for them dumping their product in my lungs without my permission

Wonder if Rolex will get around to suing this mob. Maybe if the product was smoked oysters?

This just in: Jenna Greene, from South Carolina, is being sued by Rolex for copyright infringement:
