This mechanism has a quickset function so there will be a second position for the crown to be pulled out to.
These cases are generally listed as 34-35mm in diameter. What tool did you use to measure a diameter of 33mm?
You also made the mistake of thinking that the crown was screw-down.

Unless I have missed something I'm honestly not sure you will be able to get anything out of the seller

Description does not mention quickset and does not even state watch is running. Did you research the movement (cal 565) as described in listing? Did you know it was quickset function? Did you have separate correspondence with seller about this prior to purchase? Unless you did these things and seller stated quickset was working you do not have a valid claim of misrepresentation, IMO.
As previously recommended just get it serviced and enjoy it. Next time research and ask more questions before buying maybe.
