If you don't believe Crown & Caliber, why don't you call US Customs?

PS - The information in the link that @blubarb posted is outdated. I believe the change occurred in 2015.

You might contact these guys. They are Rolex's trademark attorney's. I think they helped cause the import issue.

It's not that I don't believe C & C but it wasn't exactly a definitive article on the matter. Your right though, from everything I have been able to quickly pull together on it, it does seem as though a significant change was made in 2015. However there is still some legal distinctions to be made between Import restrictions (of which I don't think there are any) and trademark protections, but this seems a more complex issue and I can't believe would effect personal and one off sales into the US, more for those grey market dealers I guess. Personally I have no skin in the game until I sell a Rolex into the USA, which Is likely on the cards soon. Such a restriction and a possibility of confiscation was something I was totally unaware of until I read this thread, and now a number of others. I will take your advice and email, not phone though, the US customs and get the current official position.

Thanks for the heads up on that.

I'll email the US Customs for the current situation rather than stir the lions 🙄 at this point 😀

We have nothing like that, or have ever had anything similar in Australia, that I am aware of. I suppose a much smaller market and quite well controlled by the big watch groups.

Email sent and I'll update in about 3 weeks which is the ETA for a response acording to the CBP. If nothing else, it will be good to have their position in writing for those of us uncertain of the current rule.

Too bad you aren't a bit closer to Manhattan and check in person. If Rolex's attorney's couldn't give you a definitive answer, you could head up the street to 725 Fifth Ave and check there. (Trump Tower).

I believe the Donald will share time between TT and the White House and the soon to be First Lady will be living In their apartment at the TT permanently- interesting days ahead for all. I suspect The Donald wears a Rolex, a big beautiful gold one. 😁👎

Okay, Inspector Blubarb has received a reply from the United States CBP and is as follows :

This 1675 was imported from Italy Via Fed Ex in September 2016 with no problems. My seller had problems with the first courier who had the same Rolex mis information. The second courier got it to fed ex with no issue. Plus it was insured and declared as a Rolex 1675 for what I paid for it. I have found Fedex lovely to deal with. I did have a chat with them during clearance about how to divvy up the duty but no one in customs cared that it was a Rolex. Hope that helps.

I think you would have to be incredibly unlucky - most likely one of those rules that only the incredibly officious would know about or care about or unless you send a package like this:

Lovely looking 1675 btw.
I have always found FedEx to be the quickest from Aust. into the US.

I think it is definitely an IPR issue, but I am not sure if the US CBP sees it as their primary role (aside of the IPR centre) to act as an enforcer for Rolex when there are more pressing issues to be on the lookout for.
