Not sure if you are a lawyer, but your avatar suggests so. In any case, question for you: if said pictures had been posted in a previous thread on the forums somewhere, does the person who took the original shots maintain the intellectual property on them or are they now considered "public" property?

There is a “public domain”/“fair use” argument to be made. Forum members post photos of watches listed on eBay and other auction sites all the time without attribution to the seller as part of “what do you guys think about this watch” threads. On a simpler level, though, I think that it’s really just a matter of common courtesy to ask for permission. If the owner of the photos didn’t want them used, then why not comply? That being said, do I think it’s reasonable to send a rude demand to remove the photos or torpedo a sales thread? Absent a very good reason, no.

The example you use it's more or less understood the pictures come from the auction, that's fair use.

To use a photograph as a description for a personal use without attribution is copyright infringement.

Sent me an angry PM or taken a public dump on my sale.
In my time on OF I have purchased quite a few watches and wow what great guys they are! I enjoyed every moment and the watches of course.
Person to person its always been enjoyable but publicly there are some how get great pleasure out of bashing others at any chance they get. Quick to judge, quick to sentence.
Shame really. I myself really have only the best intentions in mind and will probability do things differently in the future.

To add to my previous post, the photos ARE the property of the individual who took them and so you do not have the unqualified right to use them without permission. That being said, I’m not sure why the owner would object unless the photos were copyrighted or there was some other valid reason to prohibit their use.
I know that you're right, but on reflection I know I have at times been guilty of posting e.g. a dealer's photos of one of my acquisitions (never, I hasten to add, in a sales listing!). I can't recall ever asking permission either formally or as a courtesy, and although I usually cite sources I know I have not done that either. So, I'm throwing no stones. But I do wonder now - is there maybe an implied term in the contract? So, if Dealer X sends me some extra photos by DM to persuade me to buy, has s/he maybe sold me the pictures as well? I've never been pulled up on this, but I'm just interested.

2- It was obvious to me that owning the item gave me the rights it's photos.

Well... no. Photo taken by X are X's property (except when there is a contract involved, and even then it is complicated). Asking about it then using them, why not.

Also, fyi: a forum I know require a picture of the watch with the username of the seller written on a crumpled paper. Proof of ownership. Only reusing old pictures on a listing, mhhh 😒 not exactly reassuring in a buyer's point of view.

It can't be repeated enough.

If you use a picture that's not from one of the sharing sites like imgur, where public use is part of the deal, you should say "seller pictures" or the like. A couple of keystrokes.

Professional looking pictures taken in the unspecified past to represent CURRENT condition amounts to a scam anyway.

In a broader perspective- The better the pictures the better.
I assume it best for OF members to receive the best quality pictures they can no matter who took them. Better that then sub quality photos leaving out details, no?

I am genuinely curious as to what you are looking for? Some sort of confirmation that you didn't do anything wrong?

To me the obvious solution is that you spend a few hours learning how to take better photos. It will be of value in other walks of the life too 😀

Why are your photos sub quality? This is a very fixable problem.

By the way, copyright laws can vary significantly by country, as can website site "terms of service" and licenses for use of user-created content.

Just send me the watch, I'll take some photos for you. 😉

Yoni, you have been getting good advice here about the photos. But I sense that you are posting because you are rightly upset about the rude and unpleasant way you were treated. I agree with you that it is even harder to take when you are somewhere new, or it's not your first language, and that's not acceptable. But please rest assured, everyone agrees with you on that, and actually that is what makes OF quite an unusually nice online forum. As for whoever flamed you in the first place, karma will come to them, especially when they read all this. So really, sincerely, you can move on now, head held high. OK? Good luck to you!

Bullshit.

I did write "as far as I know" so bullshit would probably not be the best response. But pictures on forums are not protected by copyright.
Of course it would be illegal to post a photo protected by copyright on a forum, but once it's up there it can be shared by all.
Otherwise sites like FB, in stag and even Watcpatrol would go our of business.

Let me just end by saying....
Theres not always a right and a wrong and what is clear to some as right might seem different to someone, especially if he live in a country on the other side of the planet.
Thank you all for your perspectives, I'll try and do things better next time but no doubt I'll screw up somewhere else. Ha Ha.
