Right, I wanted to use the nicer conversion rates of wise.com . Turns out, its much more expensive now. As I said, he made a perfect tagged video for me, so I had no doubt he would not have the watch. He was directly contacting me via my page enicar101.com, usally not the place for scammers. Maybe he got more requests on his Craigslist sale post (i found after I closed the deal) and decided to cash more than once. The sale post is still online.

Nothing new here. @Wesley03 didn't got another reply. A friend texted him the seller this week, watch was still available. I filled out a report to the police in Tulsa and got a case number.

Since I guess there is no hope anyway. This is the craigslist link of the sale so be warned:

Couldn't read the serial, but it has a wrong crown, probably from the brand "Milion" or "Wittnauer"

I paid 3.500$ Thats the amount he also told Wesely what his price is. But looks like he looked deeper now into the value of theses watches and is asking around 5k $ as far as I heard. If you can get Banking details, that would for sure help.

Tel. Number is the same I got from him.

I got reply from the police:

"Mr. xxx,

I am in receipt of your report. Will via wise.com cover your money on the fraud? The problem we have on our end is that if I file a case on Mr. Davis you have to be willing to come to court here in Tulsa and sometimes the case will require you to come more than once and since you live in Germany I would not think that would be an easy task. I have left a message with Mr. Davis in reference to this case. If you have any questions, feel free to contact me.

Thank you,"

"Mr. Davis is not in prison he was released and is on probation. No, our District Attorney needs the victim present in court. We can hope for someone else to be scammed here in Oklahoma and can file on that case if and when that happens. Sorry"



Well,...I am really not impressed by the American law system. I thought when someone is on probation, the Police will check him out for sure. Also why do I have to be there in Person? In Germany the AD could do this for you if I am not mistaken.

You may be able to hire an attorney in Tulsa to do that stuff for you, but it will cost you $. And you may be able to add it the other costs you are trying to recover, but you might need a separate civil lawsuit. I'm not an lawyer, but I have filed in small claims court twice for fraudulent transactions. They were not worthy of filing as criminal reports according to the police. I won both cases, but in one instance the other party never paid up...

I offered $ 6800 via Bank granted cheque and collection in person on a public library or Big Bank branch, where he can convert into cash. No answer yet.

This is crazy, but I actually purchased this watch in person on the 20th. I live about an hour from Tulsa and drove up to meet the guy.

I didn't find out about this until I emailed Nico yesterday about the originality of the watch and he recognized it. I hate that Nico is currently out $$ and I have a law enforcement friend who is looking into options.

Hopefully something can be done and there aren't other victims of this jerk out there. I count myself lucky that I was not robbed, or worse, and I'll definitely be reconsidering risks I'm willing to take.

Sixth Amendment of the US Constitution:

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

I'm not an attorney (although I did help my first wife study in law school 😁), but I think this may be the reason that indirect, or "hearsay" evidence, is generally not allowed. In the US, even traffic tickets are sometimes thrown out if the police officer who issued the ticket doesn't show up to testify.

Interesting that this scammer was in prison and now on probation. Hopefully they will keep a closer eye on him.
