Hi all, I'm posting this on behalf of Mike Steward who ran the late and much lamented Phoenix Straps

STATEMENT:-

"It has come to our attention that there is somone online trying to imitate us and appears to have "reborn the brand in 2024" along with a website and photographs of counterfeit straps trying to associate themselves with our company. We will not give them the credit of providing a link but please report their account on socials etc if you come across them, but be assured they have nothing to do with our company, Phoenix Straps Ltd.

More importantly please do not purchase their straps which does not represent the quality we have spent a generation delivering to our loyal customers. "




Mike Steward here, the current, active and exisiting Managing Director of Phoenix Straps Ltd (estabilshed and registered in the UK in 1939).

I have not been one for posting much on forums, the last time being when International Watchman decided to register the term NATO making it extremely difficult for the whole industry.

However, it has come to our attention that yet again somebody has this time, taken our good name and incorrectly implied ownership of our company. Although I am in the process of retiring and winding down the long standing manufacturing facilities in the UK, I can state that we have had no discussions with any person/firm/organisation which has resulted in any form of handing over our business/name to any third party.

This new entity has cleverly used names and information to manipulate themselves into making people believe they have taken over our business, this is totally incorrect.

Although we have initiated communication with the third party as a result of their actions, they have been limited in any reply other than the removal of certain claims and content from their website and remain anonymous. It appears they are hiding behind incorrect information including a misleading address in the UK and no names appear as contact on their site.

The statement I wish to make is that the original Phoenix Straps Ltd has no connection with this new entity. As in any business, we have no problem with genuine competition but identity/branding theft or the use of misleading/incorrect facts to make your product appear as if it is a genuine product is totally misleading and unreasonable.

For information, due to the nature of our operations to date as a manufacturer, we have never needed a website. We continue to sell existing remaining stock on Ebay where we feature our genuine product as we wind down the operations. We have a range of original Genuine Phoenix Straps available via Ebay but styles and sizes are dwindling as stock is sold, but be assured they are all manufactured here in the UK and not in China!!!

I would like to take this opportunity to thank you all for the support you have given us to date, I just wish I could have retired in a more gracefull manner!!!

Update:

It has now been brought to our attention that the people that have lauched a fake/spam website using our name have now filed a trade mark application for our name of Phoenix be be used in assosciation with NATO straps!!
They have not only tried to claim they have taken over our company but now using our history and the fact we have manufactured these type of straps in this attempt to achieve a trade mark status.

I have to restate we have not sold our company to any third party, and we have not been able to open any line of communication with these people as they have not had the courtesy to reply to any of our communications.
This trade mark submission is using false statements in the application stating the first manufacturing date (which is incorrect) but trying to steal our IP. Having gone through something similiar with International Watchman I personally feel that something needs to be done to stop this absolute disgracefull behaviour.

This trade mark application is taking place in USA and as we are based in UK I am asking if there is anybody out there in the watch community that can help us against these imposters and try to bring this matter to a conclusion.

I am all in favour of competition but our good name in the industry goes back a long way and we are proud of what we have achieved , but to have imposters come along and steal not only our name but history to try to give credence to their fake products really does bend good business practises.

Former patent examiner here, with a diploma in IP law from the UK.

You can file an opposition to the trademark application. They need to demonstrate that they have been actively trading under that name, and are continuing to trade under that name. Further, if you have evidence that you have been trading under that trademark in the US, you could apply for a trademark there yourself.

It is definitely possible to challenge their application though, and even if their application was successful you can still challenge the validity of the trademark at a later date.

Also, an application doesn't mean anything anyway, as if they can't demonstrate that they are operating and trading under that trademark, and have been doing so for some time, then it will be unsuccessful.

Another thing you can do to gather evidence would be to do a survey of some kind from your customer base in the US to ask them if they associate your brand name with nato watch straps. This can be used as further evidence that their trademark application should be rejected.
