Well I have my predictions on the outcome of this. That last email to Rocco drawing a line in the sand and attempting to intimidate isn't going to help matters. Probably will be viewed with amusement.

I think one thing that could make a difference is filing a claim in small claims court. People often take getting served court papers more seriously.

The obvious issues are the logistics.

This exact situation happened to me and is the single reason I cooled off on watch collecting. I’ve bought maybe one high value piece in the last 5+ years because I can’t assume I’ll ever be able to sell one and not get scammed.

If you ever want something for free on eBay, just call your credit card and say it arrived “not as described.” No one will do a thing. You get refunded, the seller never sees their item again. It’s criminal (literally).

It's lot of paperwork and time, but I will take eBay to the Australian Financial oversight Ombudsman regarding the practice to tell the buyer, he does not have to send the Watch back to the Seller, when a Chargeback occured. They police eBay's Australian banking licence for customer complains. I did it once a few years back and as soon as these guys starting collecting answers from eBay, they refunded me without a word.... Will report back in a few months if that works again. So, will invest a big effort to go the Fraud via the Law and eBay intern rule avenue via the banking regulator.

Short update: Initiated Fraud claim with my Bank here : Unauthorized transaction by eBay. Took a few days, but they clawed it back from eBay. Some fees involved, naturally. So, financial hit solved. All bank ties with eBay cut. Now eBay will listen, if they want something. 2. Reported Theft with Police here. Docus lodged. Theft happened in the USA ( was and is not send back.... Buyer vanished from Communication, as to be expected ). Contacted Fair Heaven police Chief. Twice. Docus sent. Name and details submitted. No answer so far . Maybe too uninteresting .... 3. Next USA Step: FBI wirefraud investigation of that Buyer. 4. Next Down Under step: report eBay behaviour ( refund unauthorized before receiving my watch back AND letting the " Buyer " know, that he has no obligation to return the Speedmaster in addition to keep the refunded money ) to the Ombudsman for the Financial Regulator to go after eBay Australia' s banking licence. Because encourage Theft of Now My Watch Again ( after the refund) in writing to me and the " Buyer " . Which will be very questionable in accordance with the very stringent Australian Consumer Protection Laws. If I were a Lawyer, I'd think about a Class action against eBay. There will be many more cases like mine never followed through....

Moral of the story.
Don't stiff a lawyer, especially one who has time on their hands, no expense account to justify, a distrust of corporations and an intense dislike of scumbags.

New Update: The Fair Heaven Police department responded today. They assign one Officer to attend to the Omega Speedy theft by Rocco Pizzarelli . And get back to me .... Good on them ! Just need patience and never giving up.

My tax deductible Director of Security, the Guard Poodle Dash, just started to pay attention now .... Still , pending the outcome of the Police Chief's finding in NJ, the Wirefraud case with the FBI and the last case: the Australian Financial Regulator for eBay's Banking licence, in eBay as a facilitating platform for Aiding and Promoting Theft of 3. Party Property, are in the Pipeline ...

Funny, just thought to update today ..... A few things happened. Australia: I changed my Bank access for eBay transactions. No card associated. Cleared all accounts of funds, money parked in an different account. Reported fraud by eBay for unauthorised access to my accounts to my Bank. They reclaimed the Money. Charged $160 for that, which I paid happily. Then the usual: eBay=you owe us. Me: not until my watch is returned. (The eBay refund made me the owner of my Speedmaster again.) eBay: International Collections came in. Me: Your attempt is regarded by myself as harassment of an elderly Gentleman with ill health. No more emails. eBay: 2. Attempt to get the money from my Bank. No funds to steal.... eBay: Sydney lawyer called on behalf of eBay. My answer the same as to International Collections. Plus: One more BS from eBay and I take them to the Ombudsman for Financial regulations and go after eBay's Banking licence in Australia. Reason: Tell my customer, that he can keep the Omega and the Money refunded unauthorized by eBay , goes against Australian customer protection laws. 2 days later : eBay changed my eBay account status from minus $ 4000 to zero. Done.
USA Buyer local police department: a newbie Patrolman was assigned to the case and recovery of the Speedmaster. He was oblivious to the whole internet eBay rule matter. Took weeks to school him. Then Karma came along ... The Speedmaster Thief reported a break in and many valuables stolen , an Omega chronograph being part of it..... Then I skipped the 2. Option , the FBI wirefraud report. Fazit: don't give up. Even very big corporations are vulnerable. They hope to get away with Lawyers waiting in the wings .... Like the Orange One .... Me: Lesson learned to restrict access to my accounts the clever way without any backup Cards on file. Achim

No. eBay is very quiet now. That Damocles sword with the Banking regulator from my corner is something, they will avoid . It is a threat to their Compliance in Australia.

Achim, dreadful you’ve had to endure all this stress. Can’t be easy. You’re fortunate to speak the same language as the buyer’s law enforcement agency (I was conned by an Italian eBay seller and don’t speak Italian!). I seriously doubt he had a break in but guaranteed that he will never enjoy his ill gotten watch and will never be able to openly sell it without risk to him.
